SCOPE OF THIS ACKNOWLEDGMENT
This Acknowledgment and Waiver is a condition of renting from Austin McQuaid Rental and Leasing Inc. and must be signed by every renter. It applies to ALL deliveries, placements, relocations, repositionings, and pickups of any rented unit or equipment at the above-noted property (or any other property directed by me/us) throughout the entire rental, including: any initial delivery and placement; any change to the delivery or placement location requested by me/us before or after delivery, whether in writing or verbally; any future relocation or pickup; and any instance in which delivery equipment must leave gravel or pavement — including driving on or across grass, lawn, soil, or other soft surfaces — in order to deliver, place, relocate, or retrieve a unit. No separate acknowledgment is required for each delivery, placement change, or pickup; this Acknowledgment applies to each of them.
POTENTIAL HAZARDS AND RISKS
I/WE acknowledge that deliveries, placements, relocations and pickups may involve potential hazards and risks, including but not limited to:
• Damage to grass
• Damage to trees
• Damage to plants
• Damage to driveway, including when driving off the edge of the driveway
• Damage to pavement or gravel caused by the weight of the unit during placement or delivery
• Buried items (sewer, cables, field tile, etc.)
• Becoming stuck and having to be towed out (additional charges apply)
• Inability to retrieve the unit in adverse weather or change of season
I/WE hereby acknowledge that I/we am/are the owner(s) of the above-noted property, or am/are authorized by the owner(s) to direct the delivery and placement of units on it, and that where I/we choose a unit location, delivery route, or site condition that Austin McQuaid Rental and Leasing Inc. or its employees advise is not recommended, the risks described in this Acknowledgment apply, and I/we direct Austin McQuaid Rental and Leasing Inc. to proceed notwithstanding that advice.
I/WE understand and acknowledge that if a unit is placed on grass, soil, or any surface other than gravel or pavement, there is a significant risk that the unit may sink into the ground during soft conditions such as spring thaw, heavy rain, or general ground softening, or become frozen into the ground during winter conditions. I/WE further understand and acknowledge that the placement or delivery of a heavy unit may cause damage to pavement or gravel surfaces, including cracking, rutting, or depressions caused by the weight of the unit or the delivery equipment, and that Austin McQuaid Rental and Leasing Inc. shall not be responsible for any such damage.
I/WE further acknowledge that in such circumstances, Austin McQuaid Rental and Leasing Inc. may be unable to retrieve the unit safely or at all until ground conditions improve.
I/WE understand and acknowledge that Austin McQuaid Rental and Leasing Inc. and its drivers have no way of knowing how soft the ground is, and no way of seeing or detecting buried items, underground hazards, or other site conditions or issues, prior to such issues occurring. Austin McQuaid Rental and Leasing Inc. relies solely on the information provided by the on-site contact or the instructions left with the order in carrying out any delivery, placement, relocation, or pickup, and I/we am/are responsible for ensuring that such information and instructions are accurate and complete.
By requesting or directing any delivery, placement, relocation, or pickup at any location, I/we agree to be fully responsible for:
• Any attempted pickup charges, whether successful or unsuccessful;
• Notifying Austin McQuaid Rental and Leasing Inc. when ground conditions are safe for pickup;
• Any towing, crane, recovery, or additional equipment required to retrieve the unit or truck;
• Snow removal, site preparation, or ground remediation required to access the unit; and
• All additional monthly rental charges that may accumulate until the unit can be safely retrieved.
I/WE understand and accept that any delivery, placement, relocation, or pickup — including any change of location requested by me/us — may result in damage to my/our property and/or additional costs or complications in connection with future pickup or retrieval.
I/WE acknowledge and agree that all such work is performed entirely at my/our own risk, and that Austin McQuaid Rental and Leasing Inc., its employees, agents, and representatives shall not be held responsible or liable for any damage to my/our property or additional costs resulting from any delivery, placement, relocation, or pickup carried out at my/our request or direction, including where carried out against their advice.
I/WE further acknowledge and agree that if any damage occurs to the property, or if any additional work, equipment, labour, towing, recovery, or remediation is required as a result of any unit being placed at my/our request or direction, I/WE shall be fully responsible for all associated costs.
I/WE further acknowledge and agree that by sending Austin McQuaid Rental and Leasing Inc., its employees, agents, or equipment into any location, I/we am/are confirming that I/we know it is safe to do so, and I/we accept full responsibility for any damage to my/our yard or property and for any damage to the equipment of Austin McQuaid Rental and Leasing Inc. arising from entry into the location. I/WE further understand and agree that Austin McQuaid Rental and Leasing Inc. may in the future need to delay a pickup or delivery, or may fail or abort a future pickup attempt, as a result of the location or its conditions, and that I/we shall be solely responsible for all time billed in connection with any such delayed, failed, or aborted pickup or delivery attempt. If Austin McQuaid Rental and Leasing Inc. is unable to pick up the unit in the future as a result of the location or its conditions, I/we shall remain responsible for the monthly rental charges until the unit can safely be retrieved.
I/WE acknowledge that I/we have read and understood the foregoing and agree to its contents. This Acknowledgment and Waiver remains in effect for the full duration of my/our rental agreement(s) with Austin McQuaid Rental and Leasing Inc. and applies to every delivery, placement, relocation, and pickup during that time.
Where this Acknowledgment and Waiver is presented, completed, or accepted online or electronically, my/our electronic signature or acceptance at the end of this document shall constitute acknowledgment of ALL of the potential hazards listed above and acceptance of all of the terms of this Acknowledgment and Waiver, whether or not I/we have read each item. This Acknowledgment and Waiver may be executed and delivered by facsimile, .pdf signature, or any other form of electronic signature, and such signature shall be binding for all purposes hereof without delivery of an original signature being required.
